CVM ILLE invites you to consult its terms of sales that you will agree to accept if you wish to place an order on our website www.cvmille.com.

 

The range and sale of products on our website ("cvmille.com") are governed by these Terms and Conditions. We advise you to read them carefully. Items purchased on cvmille.com are sold directly by CVM ILLE BV, Sint-Katelijnevest 6 2000 Antwerp.

Only individual customers and "end user" companies buying for purposes other than resale may place orders on the cvmille.com site. The resale or distribution of items purchased on cvmille.com is strictly prohibited. Furthermore, each time you place an order on cvmille.com, you will be confirming your acceptance of the Terms and Conditions in effect at the time of your order. Given the sales policy described below, CVM ILLE reserves the right not to act upon orders placed by anyone other than an "end buyer", or orders that do not comply with its sales policy as defined herein. These terms and conditions may be modified, particularly to accommodate any regulatory changes. The new terms and conditions apply as soon as they have been posted on cvmille.com

ARTICLE I - SALE AND TRANSFER OF OWNERSHIP
The products are delivered at the time of sale in perfect condition, for normal and current use. We undertake to fully inform the customer of all aspects of use of the product, which the buyer recognizes and unreservedly accepts at the time of sale, by the payment of the purchase price which results in the transfer of property.
We insure the pieces until the moment of their sale. The customer is responsible for the insurance of the objects purchased from the moment of purchase, including on our premises.
The customer may renounce the sale within ten calendar days of the sale, the start date of this renunciation period being the date confirmed by our acceptance to the collection of all effects or cash used for the perfect payment of the sale. In the event of acceptance by us of payment terms, the aforementioned period begins to run from the moment when we definitively hand over the order to the customer.
In this case, we will be able to retain on the reimbursed sum, beyond the costs related to the collection and reimbursement of all sums, all the costs and disbursements made necessary by the reordering of the product purchased, that the customer will have used during the renunciation period, which he undertakes to accept without reservation.

The customer may renounce the sale within ten days of the sale, the starting date of this renunciation period being the date materialized by our acceptance to the collection of all effects or cash used for the perfect payment of the sale. In the event of acceptance by us of payment terms, the aforementioned period begins to run from the moment when we definitively hand over the order to the customer.
In this case, we will be able to retain on the reimbursed sum, beyond the costs related to the collection and reimbursement of all sums, all the costs and disbursements made necessary by the reordering of the product purchased, that the customer will have used during the renunciation period, which he undertakes to accept without reservation.

ARTICLE II - AVAILABILITY AND ORDERS ON THE SITE
Our product offers on the cvmille.com website are offered while stocks last. Check at the time of your order, item by item, that the number, size and price are taken into account in your order form. When a product is no longer available, you can contact us (contact@cumille.com) so that we can inform you, if necessary, of its new availability on the site or the possibility to order it with a deposit.
When ordering, you can create your online account with your personal details and keep them updated. The contract is deemed concluded when CVM ILLE receives the order form electronically, once the accuracy of the order data has been verified. Before purchasing the products, by sending the order form, you are asked to carefully read the Terms and Conditions of Sale. By transmitting the order form electronically, you accept them unconditionally and you agree to comply with them.

- ORDERS WITH DEPOSIT
Once your deposit order has been placed, it is no longer possible to make changes such as the quantity or size of a ring. Your order cannot be canceled either except for a force majeure delay in delivery.
According to article L121-20-2 of the consumer code, the right of withdrawal of seven days cannot be exercised insofar as the customer's order implies the execution of the production of the jewel.
When you place an order with a deposit, we ask you to pay 50% of the total price of the jewel, excluding delivery costs. The remaining 50% and the delivery costs are due when the jewel is ready to be sent to you.
When we finish manufacturing your jewelry, we will send you an email notification with the information allowing you to pay the amount due as well as the delivery costs. Once the payment has been received in full and validated, your jewel will be sent to you and you will receive a tracking number.
It is important to keep in mind that a deposit order requires a waiting period between the time the order is placed and the time you receive your jewelry. This period can vary from a few days to several months according to the jewel ordered. The estimated delivery date will be given to you upon request to contact@cumille.com.
Failure to withdraw an order within six months of the payment of the deposit implies the final renunciation of the purchase. The amount of the deposit is acquired and the pieces are put back into commerce without the buyer being able to oppose it in any way.

ARTICLE III - PRICES AND PAYMENT
The prices of our products are indicated in euros all taxes included, excluding participation in shipping costs. All orders must be paid in Euros. CVM ILLE reserves the right to change prices at any time, but the products will be invoiced on the basis of the prices in force at the time of order entry, subject to their availability. When you click on “order” you can pay for your purchases in different ways:
- via Stripe: Visa, Mastercard, American Express, Credit Cards, Alipay, Bancontact, EPS, giropay, iDEAL, Multibanco, Przelewy24, SOFORT, WeChat Pay
- via PayPal: contact@cumille.com

If you wish to make another bank transfer or pay in Bitcoin, please contact us at contact@cumille.com.
The shipment of your order takes place only after the verification of your payment method.

ARTICLE IV - DELIVERY
The products purchased on the cvmille.com site can be delivered under certain conditions described in the delivery section.
For reasons, notably of security, CVM ILLE will not process any order for which a post office box or Cedex address is provided.
In order for your order to be delivered, you agree to provide your full address when ordering, including the additional information necessary for the smooth delivery (building, floor, staircase, access code, etc.).
All orders that we receive are managed from our STVDIO in Antwerp and manufactured in our Parisian workshop by our craftswomen. If the jewel you ordered is in stock, it will be shipped within 1-3 business days. If it needs to be specially crafted,  adjusted or customized, the shipping delay will be 4 to 6 weeks maximum.

An email will be sent to you to confirm the processing of the order and shipping.
If you order several items, the order will be shipped in a minimum package.
We deliver your orders worldwide.

-ANTWERP: STVDIO check-out

In Antwerp, depending on the availability of products, you can benefit from free check-out at the STVDIO. Remember to specify your preferred delivery method when confirming your order, or contact us directly by email to benefit from the check-out option.

-ANTWERP: bike delivery
In Antwerp, depending on the availability of products, you can benefit from free bike delivery. Delivery will take place over a 3-hour window after validation by customer service. Remember to specify your preferred delivery method when confirming your order, or contact us directly by email to benefit from courier delivery.

Delivery to other areas is provided by one of our shipping partners depending on the area. Delivery will be made within 3 to 10 days, depending on the country.
To receive your order as soon as possible, we recommend that you have your orders delivered to an address where you are present during daytime hours (your workplace for example), or to make sure that someone can receive the package for you.


- Customs Tax: For deliveries outside the EU, Belgian VAT (21%) will be automatically deducted from the invoice price.
Customs duties, local taxes, import duties or state taxes may be required by the carrier who will deliver your order. These amounts will be at your expense and are your sole responsibility.


- DELIVERY MONITORING
We follow each of our shipments personally and you too can track your order using a tracking number which is communicated to you as soon as your package leaves our studio.


- DELIVERY ISSUES
Any defect or delay in the delivery of more than eight 8 working days must be reported to our Customer Service as soon as possible (contact@cumille.com). Any complaint made beyond 15 calendar days after the date of validation of your order cannot be taken into account. You must check the conformity of the goods at the time of delivery. In case of anomalies noted (open package, damaged product, etc.) you must report it on the delivery voucher and contact Customer Service by email. In case of non-conformity of the products purchased or if they do not satisfy you, you can return them or request their exchange or refund under the conditions provided for in the article "RETURN / EXCHANGE".

ARTICLE V - GUARANTEE
The date of purchase constitutes the date of departure from the legal warranty of the product. In this, the warranty is for one calendar year from the effective date of purchase.
The warranty covers defects in the product sold, unequivocally attributable to a defect in the manufacture or assembly of the goods by CVM ILLE.
The warranty does not cover: alterations in the appearance of the parts' finish, scratches or polishes, impacts, punches, abrasions, breaks, dirt, and more generally any mechanical or chemical damage, identified or unknown, accidental or voluntary, coming from, or consecutive to the use, by the customer of the parts after their delivery.
This clause extends to parts taken in their entirety, as well as their sub-assemblies and components, coatings, and additions of any kind, including any specific packaging.
The warranty is null and void in the event of an intervention by a third party on the parts, without the written agreement of CVM ILLE, or an accredited representative of the author of the parts.
This commercial guarantee is independent of all other guarantee clauses, arising from the legislation in force, both Belgian and European, which would engage the responsibility of manufacturers, craftsmen or artists.

-BEYOND WARRANTY REPAIRS

During the legal warranty period, and then indefinitely over time, the parts sold can be repaired as far as possible, upon acceptance of a repair estimate presented to the customer.
These additional years do not in any way constitute an extension of warranty, express or implied, on the parts sold and do not constitute an obligation of the company, which the customer recognizes and accepts. Repairs are themselves guaranteed for three months from delivery to the customer.
CVM ILLE assumes no obligation to undertake such repairs after the statutory warranty period.
After the legal warranty period, all interventions and repairs on the part are deemed to be chargeable, which the customer declares to know and accept.

 

ARTICLE VI - RETURN / EXCHANGE
CVM ILLE is committed to providing you with high-quality products. Despite this, if you are not satisfied with the product purchased, CVM ILLE agrees to exchange it or refund it to you.
The return costs will be your responsibility and, in the case of an exchange, the costs of sending the new jewellery will be our responsibility.
In accordance with the provisions of articles L.121-20 and following of the consumer code, you have a period of 7 days from the date of receipt to return the products to us. In the case of a refund, it will be made in the same way as the payment was made and within a maximum of fifteen days after receipt of the returned item. CVM ILLE reserves the right to deduct from a reimbursement any bank commissions charged according to the method of payment.
In addition, for one month from the completion of the sale, parts sold unworn (returned in new condition, in their original packaging) can be exchanged, and/or be the subject of credit. During this period of one month, counting down as above, the exchange of obviously worn parts may be accepted, at our sole discretion. We will then be able to request reimbursement of the costs of restoring the attached parts.
This cost will be deducted from the amount of the credit if any. The assets are valid for six months, this period may be extended exceptionally only once by CVM ILLE, for an additional period not exceeding six months. We will then establish in writing such an extension.
Damaged or incomplete items will not be returned and will be returned to you as is, at your expense. Promotional or sale products will not be exchanged or refunded.

ARTICLE VIII - COPYRIGHT AND RESPONSIBILITY
- COPYRIGHT
This site presents photographs and illustrations of pieces created by CVM ILLE. These images and associated information have no contractual character. Consequently, the responsibility of cvmille.com cannot be engaged in the event of an error in photography or text.
CVM ILLE releases completely and without limitation of duration any responsibility as for the presentations made on this site.
All texts, comments, works, illustrations, and images reproduced on the cvmille.com site are reserved under copyright and intellectual property for the whole world. As such, in accordance with the provisions of the Intellectual Property Code, only use for private use is tolerated, subject to different or more restrictive provisions of the Intellectual Property Code.
Any other use (total or partial reproduction, extraction, or copy of the images contained in this site) constitutes counterfeiting and sanctioned under Intellectual Property before the competent courts, without prior authorization from cvmille.com; All rights reserved.
CVM ILLE keeps all the intellectual property of its models.
Photographers keep the intellectual property of their works, under the conditions of transfer of their rights which prevail for each work.


- RESPONSIBILITY
The products offered comply with current Belgian legislation. It is your responsibility to check with the local authorities in your country about the possibilities of importing or using the products or services that you plan to order.
CVM ILLE cannot be held responsible for the non-performance of the contract concluded in the event of stock shortage, unavailability of the product, in the event of force majeure, disruption, flooding, fire or strike, in particular by the services postal and means of transport or communication. Cvmille.com will not incur any responsibility for any direct or indirect damage due to these risks.

ARTICLE IX - OBJECTS ASSIGNED BY CUSTOMERS
We can accept to receive entrusted objects, stones, or metal, of all kinds, intended for the development of personalized pieces.
On the other hand, the burden of proof of the quality of the objects entrusted belongs to the client and must be brought before the establishment of the entrusted receipt.
In the absence of such certificates, we can accept the deposit on sight and in good faith, but we do not accept any responsibility for the quality of the objects given to us, including in the event of the discovery of faults during dismantling or false stones which would prove to the appraisal after said dismantling, which the customer must undertake to accept irrevocably and without reserve.
The duration of custody of entrusted persons is agreed between CVM ILLE and the client, without ever being able to exceed three months.
The insurance of entrusted is our responsibility, from their reception and until return to the customer, with or without assembly and use. We do not accept any responsibility whatsoever for the custody of those in care who have not been removed in a timely manner.

ARTICLE X - APPLICABLE LAW - DISPUTES
This contract is signed in English and subject to Belgian law.
The law applicable for any legal dispute is Belgian law and the Belgian courts will have jurisdiction.
Typos or mistakes do not cancel the clause that contains them. Similarly, if a clause is made invalid by law, the rest of the GTC retains its value.


ARTICLE XI - PERSONAL INFORMATION
Cvmille.com undertakes not to disclose to third parties the information that you communicate to it. These remain confidential. They will only be used by our internal services for the processing of your order, to strengthen and personalize the communication, in particular by the cvmille.com newsletters to which you will have subscribed as well as in the context of the personalization of the site in function of your interests.
Consequently and in accordance with the data-processing law and freedoms of January 6, 1978, you have a right of access, of correction, and of opposition to the personal data concerning you. To do this, you just need to send us a request by email (contact@cumille.com).

ARTICLE XII - METALS AND STONES
- METALS
We guarantee the title of the precious metal alloys as well as the affixing of the hallmarks of the Belgian national guarantee, in accordance with the law in force. For reasons of fragility or aesthetics, certain parts may exceptionally be exempted from the affixing of the hallmark of the State Guarantee, on ad hoc request and at the discretion of the State Services.
Conversely, at the request of the client, the hallmark of the State title guarantee can be affixed to any fragile part, or whose weight is less than the limits provided by the Belgian State. In this case, we accept no responsibility for aesthetic alterations or damage that may occur during the operation.

- MOUNTED AND STONE STONES, ORGANIC MATERIALS
Apart from any - not compulsory - certificates from approved laboratories given at the time of the sale, and which constitute a technical description of the stones, no other responsibility is accepted by the seller, who gives absolutely no guarantee, express or implied, on precious or fine stones. This clause of definitive exclusion of guarantee extends to all materials or natural crystalline, amorphous or organic substances, from all sources, which can enter into the composition or the realization of sold objects.
